Terms & Conditions

These Terms explain CakeNest marketplace rules, food safety responsibilities, seller obligations, buyer responsibilities, payments, refunds, and safety limitations.

1. Acceptance of Terms

By creating an account, browsing, ordering, selling, uploading content, or otherwise using CakeNest, you agree to these Terms & Conditions, the Privacy Policy, Refund Policy, Seller Marketplace Policy, Food Safety Notice, and any checkout or seller notices shown in the app. If you do not agree, you must not use CakeNest.

2. Marketplace Service Only

CakeNest is a technology marketplace that helps buyers discover and order from independent sellers. Unless CakeNest expressly states otherwise in writing, CakeNest does not prepare, cook, bake, store, package, label, inspect, test, deliver, or sell food listed by independent sellers.

3. Independent Seller Responsibility

Each seller is an independent business or individual seller and is not an employee, agent, partner, franchisee, representative, or joint venturer of CakeNest. Sellers are solely responsible for their products, ingredients, allergen disclosures, food safety practices, labeling, packaging, storage, pickup, delivery arrangements, refunds where applicable, taxes, licenses, permits, insurance, and legal compliance.

4. Seller Certification and Verification

Sellers may be required to submit food safety certificates, permits, license numbers, expiration dates, or supporting documents before selling. CakeNest may review, approve, reject, flag, or expire seller verification at any time. Verification badges indicate that information was submitted and reviewed by CakeNest, but they do not guarantee food safety, kitchen conditions, legal compliance, allergen safety, product quality, or future seller conduct.

5. Buyer Responsibility

Buyers are responsible for reading product descriptions, ingredients, allergen information, pickup or delivery details, seller messages, and checkout warnings before ordering. Buyers must provide accurate contact, address, fulfillment, allergy, and special instruction information. Buyers with allergies, sensitivities, pregnancy-related dietary concerns, medical dietary restrictions, or religious dietary needs should contact the seller before ordering.

6. Food Safety and Allergens

Bakery products may contain or come into contact with milk, eggs, wheat, soy, peanuts, tree nuts, sesame, gluten, or other allergens. CakeNest cannot guarantee an allergen-free environment. Sellers are responsible for accurate ingredient and allergen disclosure. Buyers should not consume food that appears spoiled, damaged, contaminated, mislabeled, improperly sealed, improperly stored, or otherwise unsafe.

7. Prohibited Food and Unsafe Listings

Sellers may not list food that is illegal, unsafe, spoiled, mislabeled, contaminated, deceptively described, not allowed under applicable cottage food or local rules, or otherwise prohibited by CakeNest. CakeNest may remove listings, hide products, lock seller access, suspend accounts, report serious safety issues, or take other action when risk is identified.

8. Orders, Quotes, and Fulfillment

Listings, custom cake requests, quotes, availability, preparation times, pickup windows, delivery windows, and fulfillment details are controlled by sellers and may change. CakeNest does not guarantee that every listing, order, quote, request, pickup, delivery, message, or refund request will be accepted, completed, available, or fulfilled on a specific timeline.

9. Payments and Fees

Payments may be processed by third-party providers such as Stripe. By placing an order, the buyer authorizes the displayed charge, applicable taxes, fees, delivery charges, service fees, and platform fees. Sellers authorize CakeNest and its payment processors to collect platform fees, payment processing fees, refunds, adjustments, chargebacks, and other amounts permitted by platform rules and applicable law.

10. Refunds, Cancellations, and Chargebacks

Refund and cancellation decisions may depend on order status, custom work already started, preparation already completed, seller response, buyer evidence, food safety concerns, payment processor rules, platform policy, and applicable law. Custom orders may be limited or non-refundable once preparation begins, except where required by law. CakeNest may review refund disputes but does not guarantee a refund in every case.

11. Illness, Allergy, Injury, and Safety Complaints

If a buyer believes a product caused illness, allergic reaction, contamination, spoilage, injury, or another safety concern, the buyer should stop consuming the product and seek medical care immediately where needed. The buyer should report the issue through CakeNest as soon as possible and preserve photos, packaging, labels, messages, and order details. CakeNest may investigate marketplace misuse, restrict seller accounts, remove listings, request information, or take safety action. Sellers remain responsible for the food they prepare, sell, package, store, deliver, or fulfill.

12. User Content and Reviews

Users are responsible for content they upload, including product images, descriptions, certificates, messages, reviews, and profile information. Users may not upload false, misleading, illegal, infringing, unsafe, abusive, explicit, hateful, or deceptive content. CakeNest may moderate, remove, hide, or restrict content that violates policy or creates risk.

13. Account Suspension and Removal

CakeNest may suspend, restrict, lock, hide, deactivate, or terminate accounts, listings, seller access, product visibility, messaging, payouts where permitted, or platform features if CakeNest believes a user created risk, violated policy, submitted false information, received serious complaints, failed verification, violated law, or used CakeNest in an unsafe, unlawful, deceptive, or abusive way.

14. No Professional Advice

CakeNest does not provide legal, medical, nutrition, allergy, tax, insurance, regulatory, or food safety professional advice. Users should consult qualified professionals for advice related to legal compliance, food safety, allergies, medical conditions, taxes, insurance, licensing, or business operations.

15. No Warranty

CakeNest is provided on an "as is" and "as available" basis to the maximum extent permitted by law. CakeNest does not guarantee uninterrupted service, error-free operation, seller performance, ingredient accuracy, allergen accuracy, food safety, product legality, delivery timing, listing completeness, verification accuracy, or dispute outcomes.

16. Limitation of Liability

To the maximum extent permitted by law, CakeNest and its owners, affiliates, officers, employees, contractors, licensors, and partners will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or lost-profit damages. To the maximum extent permitted by law, CakeNest is not liable for claims arising from independent seller products, ingredients, allergens, preparation, labeling, packaging, storage, fulfillment, illness, contamination, injury, delays, cancellations, seller conduct, or buyer misuse.

17. Indemnification

You agree to defend, indemnify, and hold harmless CakeNest and its owners, affiliates, officers, employees, contractors, licensors, and partners from claims, liabilities, damages, judgments, losses, costs, and expenses, including reasonable legal fees, arising from your use of CakeNest, your content, your products, your violation of these Terms, your violation of law, or your conduct. Sellers specifically agree to indemnify CakeNest for claims related to food they prepare, sell, package, store, deliver, or fulfill.

18. Changes to Terms

CakeNest may update these Terms from time to time. Updated Terms may be shown in the app or posted through official CakeNest channels. Continued use of CakeNest after updated Terms become effective means you accept the updated Terms.
