Seller Marketplace Policy

1. Seller Responsibilities
Sellers on CakeNest are responsible for the accuracy of their listings, pricing, photos, product details, ingredients, allergen disclosures, customization limits, preparation timelines, availability, service area, and fulfillment commitments.
2. Independent Seller Status
Each seller operates as an independent seller and not as an employee, agent, joint venturer, or representative of CakeNest. Sellers are solely responsible for the products and services they provide through the platform.
3. Food Safety and Compliance
Sellers are responsible for complying with all applicable food safety, labeling, health, licensing, tax, cottage food, permit, and business laws in the places where they operate. Sellers must prepare, handle, store, package, and deliver or release food in a safe and lawful manner.
4. Ingredients and Allergens
Sellers must provide accurate ingredient information and clear allergen disclosures where applicable. Sellers should disclose common allergens such as nuts, dairy, eggs, soy, wheat, and gluten when relevant. Sellers must not knowingly provide false, incomplete, or misleading ingredient or allergen information.
5. Product Listings
Listings must accurately describe the item being sold, including ingredients where needed, size, portion count, decoration, customization limits, preparation timelines, pickup or delivery expectations, and price. Misleading or deceptive listings may be edited, removed, or restricted.
6. Availability
Sellers must keep bakery hours, paused ordering status, holiday closures, vacation mode, and product availability up to date so buyers receive accurate information.
7. Custom Cake Quotes
When responding to custom cake requests, sellers should provide fair and accurate quote amounts, realistic timelines, clear design expectations, and communication about what is and is not included.
8. Fulfillment
Sellers are responsible for properly preparing, packaging, labeling when appropriate, and completing pickup or delivery arrangements for accepted orders. Repeated fulfillment failures, unsafe handling, or serious complaint patterns may affect marketplace access.
9. Refund Cooperation
Sellers agree to cooperate with CakeNest in the review of refund requests, order disputes, quality complaints, and food safety concerns. Sellers may be required to provide records, timestamps, communication history, photos, or explanations related to an order.
10. Illness, Allergy, and Safety Claims
If a buyer reports illness, injury, contamination, spoilage, or an allergic reaction involving a seller's item, the seller remains solely responsible for the food product, its ingredients, its preparation, and its handling. CakeNest may investigate, document the complaint, suspend listings, restrict account access, or remove the seller from the marketplace based on risk, evidence, or repeated incidents.
11. Payouts and Taxes
Sellers are responsible for maintaining accurate payout information and for handling their own taxes, bookkeeping, reporting, and business obligations.
12. Prohibited Items or Conduct
Sellers may not post unlawful, unsafe, spoiled, contaminated, infringing, deceptive, or prohibited items. Sellers may not misuse buyer data, manipulate reviews, commit fraud, evade platform rules, or continue selling while knowingly violating food safety requirements.
13. Account Review and Enforcement
CakeNest may review seller accounts, listings, messages, complaints, and activity for safety, trust, compliance, and marketplace quality purposes. Listings or seller accounts may be limited, paused, suspended, or removed where necessary.
14. Marketplace Role
CakeNest provides the technology platform and seller tools, but each seller remains responsible for the products and services they offer unless explicitly stated otherwise.
